Defense Base Act 33 U.S.C § 901 et seq. The Defense Base Act was created in response to the need to offer employees of civilian contractors workers’ compensation coverage. Workers’ compensation laws vary depending upon which State is involved. As such, the United States Congress developed a uniform workers’ compensation scheme by adopting the provisions of the Longshore & Harbor Workers Compensation Act, which is a federal workers' compensation statute based upon the New York Workers' Compensation Act. There is a close relationship between the Defense Base Act and the Longshore & Harbor Workers' Compensation Act.
